Agreement to Terms
By downloading, installing, or using Water Daisy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is developed and operated by Level Headed Ventures, LLC ("we," "us," or "our"), a New York State limited liability company.
Description of Service
Water Daisy is a mindful hydration tracking app that helps you visualize your daily water intake through animated daisy bloom illustrations. The App stores all data locally on your device and offers both free and premium subscription tiers.
Subscriptions & Pricing
Water Daisy offers an optional premium subscription ("Water Daisy Pro") with the following plans:
All subscriptions are auto-renewable and billed through your Apple ID. Payment is charged to your Apple ID account at confirmation of purchase or at the end of the free trial period, whichever applies.
Free Trials
Water Daisy Pro includes a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
Free trial eligibility is determined by Apple and is generally available only once per Apple ID.
Auto-Renewal & Cancellation
Your subscription automatically renews at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store.
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. No refunds are provided for the unused portion of a subscription period.
Refunds
All purchases are processed by Apple. Refund requests must be directed to Apple through their support channels. We do not process refunds directly. Visit reportaproblem.apple.com to request a refund from Apple.
Acceptable Use
You agree to use the App only for its intended purpose of personal hydration tracking. You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the App. You may not use the App in any manner that could interfere with or disrupt its functionality.
Intellectual Property
All content in the App — including but not limited to daisy illustrations, animations, design elements, text, and branding — is the property of Level Headed Ventures, LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content from the App without our written permission.
Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, or fitness for a particular purpose. Water Daisy is a wellness tool and does not provide medical advice. Always consult a healthcare professional for guidance on your hydration needs.
Limitation of Liability
To the fullest extent permitted by applicable law, Level Headed Ventures, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the App following any changes constitutes acceptance of the updated Terms.
